In ‘Hospitals Appeal Decision on Disclosure of Negotiated Rates’, WSJ journalist, Stephanie Armour, reports “The American Hospital Association appealed a decision upholding a Trump administration rule the requires hospitals to disclose the rates they negotiate with insurance companies that aren’t made public”.

Ironically, the American Hospital Association preposterously argued in their appeal “that the rule compelling hospitals to publish their negotiated rates goes beyond the statutory intent of the Affordable Care Act”, and in notable ‘double-speak’, “violates the First Amendment of forcing hospitals to disclose proprietary information”.  Our Physician and Medical Practice clients are struck by the notable irony between the euphemism, ‘Affordable Care Act’, and their ‘First Amendment’ claim on ‘proprietary information’.
